These Terms and Conditions govern your use of critical-factors.com and any products or services purchased through this site. By accessing this site or purchasing any product, you agree to be bound by these terms.
Products and Services
Kinney Group LLC offers digital products including the PIP Checklist (free), the PIP It! book, and the Structural Exposure Diagnostic service. All products are delivered digitally. Physical delivery is not applicable.
Payment
All payments are processed securely through Stripe. By completing a purchase, you agree to Stripe’s terms of service. We do not store payment card information on our systems.
Structural Exposure Diagnostic — Scope and Limitations
The Structural Exposure Diagnostic is a structural clarity instrument. It is derived exclusively from your responses to the Critical Factors Intake questionnaire. It presents structural findings and observations. It does not contain recommendations, implementation steps, advisory content, or consulting of any kind.
The report is not a substitute for legal, financial, accounting, or professional business advice. The findings are based solely on the information provided in the intake. Kinney Group LLC makes no guarantees regarding specific business outcomes resulting from the report.
Refund Policy
Given the nature of digital and consulting-adjacent services, all sales are final. If the Structural Exposure Diagnostic has not yet been delivered and you wish to cancel, contact us at [email protected] within 24 hours of purchase and we will issue a full refund. No refunds are available once the report has been delivered.
For digital book purchases, refunds are not available once the product has been downloaded or delivered.
Intellectual Property
All content on this site — including the Critical Factors Management System framework, the PIP methodology, diagnostic instruments, report formats, and written materials — is the proprietary intellectual property of Kinney Group LLC. No portion of any report, methodology, or content may be reproduced, distributed, or repurposed without express written permission.
Confidentiality
All diagnostic reports are classified as confidential and are intended solely for the executive use of the purchasing party. Kinney Group LLC treats all client intake information and report contents as confidential and does not share client-specific information with third parties.
Limitation of Liability
To the fullest extent permitted by law, Kinney Group LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of this site or any product or service purchased through it. Our total liability for any claim shall not exceed the amount paid for the specific product or service giving rise to the claim.
Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Los Angeles County, California.
Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the site following any changes constitutes acceptance of the revised terms.
